Welcome to Healy Dattero Performance Training, LLC dba/ Evolution Sports Performance (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our website, facilities, programs, services, training sessions, communications, and related offerings.

By accessing our website, registering for services, or participating in our programs, you agree to these Terms.

1. Eligibility and Participation

Participants under the age of 18 must have registration and consent completed by a parent or legal guardian.

By registering for services, you represent that:

• The participant is physically capable of participating in athletic training activities;

• You have authority to enter into this agreement;

• All information provided is accurate and current.

We reserve the right to refuse or terminate participation for safety, conduct, or policy violations.

2. Assumption of Risk

Athletic performance training involves inherent risks, including but not limited to:

• Muscle strains

• Sprains

• Falls

• Physical contact injuries

• Aggravation of existing conditions

• Serious injury or death

By participating in our programs, you voluntarily assume all risks associated with participation.

Participants and parents/guardians are responsible for consulting a physician before participation if there are any medical concerns.

3. Waiver and Release of Liability

To the fullest extent permitted under Massachusetts law, participants and parents/guardians agree to release, waive, and hold harmless Evolution Sports Performance, its owners, employees, contractors, trainers, and affiliates from claims arising out of participation in training activities, except in cases of gross negligence or willful misconduct.

This release includes claims relating to:

• Personal injury

• Property damage

• Losses arising during training sessions or facility use

4. Medical Authorization

In the event of an emergency, Evolution Sports Performance may seek emergency medical treatment for a participant if a parent or guardian cannot be reached immediately.

Participants and parents/guardians accept responsibility for all resulting medical expenses.

5. Payment Terms

All program fees, memberships, packages, and session payments are due according to the payment schedule selected during registration.

By providing payment information, you authorize Evolution Sports Performance and its payment processors to charge applicable fees.

Failure to make timely payments may result in suspension or termination of services.

6. Refund and Cancellation Policy

Unless otherwise stated in writing:

• Program fees are non-refundable once a program begins.

• Missed sessions are not guaranteed to be rescheduled.

• Memberships may require advance notice for cancellation.

• Refund requests may be reviewed on a case-by-case basis.

We reserve the right to cancel programs, classes, or sessions due to low enrollment, weather, emergencies, or other circumstances.

7. Scheduling and Attendance

Training schedules are subject to change.

Participants are expected to:

• Arrive on time;

• Wear appropriate athletic attire;

• Follow trainer instructions;

• Conduct themselves respectfully.

Repeated tardiness, unsafe behavior, or disruptive conduct may result in removal from programs without refund.

8. Text Messages and Electronic Communications

By providing your phone number or email address, you consent to receive:

• Scheduling communications

• Program updates

• Administrative notices

• Marketing and promotional communications

Message and data rates may apply.

You may opt out of marketing communications at any time.

9. Intellectual Property

All website content, branding, logos, graphics, videos, training materials, and program content are the property of Evolution Sports Performance unless otherwise noted.

You may not reproduce, distribute, modify, or commercially use our content without written permission.

10. Media Release

Unless prohibited in writing, participants and parents/guardians grant Evolution Sports Performance permission to use photographs, video recordings, testimonials, or likenesses for:

• Marketing

• Social media

• Website content

• Promotional materials

No compensation will be provided for such use.

Parents or guardians may opt out by submitting a written request.

11. Website Use

You agree not to:

• Use the website unlawfully;

• Attempt unauthorized access to systems;

• Upload malicious software;

• Interfere with website functionality;

• Misrepresent your identity.

We reserve the right to restrict access for violations.

12. Privacy

Your use of our services is also governed by our Privacy Policy.

Please review our Privacy Policy for information regarding how we collect, use, and protect personal information.

13. Disclaimer of Warranties

Services and website content are provided “as is” and “as available” without warranties of any kind, express or implied.

We do not guarantee:

• Specific athletic results;

• Continuous website availability;

• Error-free services.

Individual results may vary.

14. Limitation of Liability

To the fullest extent permitted by law, Evolution Sports Performance shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of our services or website.

Our total liability shall not exceed the amount paid for services giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless Evolution Sports Performance and its affiliates from claims, damages, liabilities, costs, and expenses arising from:

• Violation of these Terms;

• Participant conduct;

• Misuse of services or facilities.

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Commonwealth of Massachusetts.

Any disputes arising under these Terms shall be resolved in courts located within Massachusetts.

17. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Changes to Terms

We may update these Terms periodically.

Updated Terms will be posted with a revised effective date. Continued participation or use of services constitutes acceptance of revised Terms.
